As General Counsel, this employee is responsible for the coordination and handling of all legal matters arising from the administration of state and federal laws governing, and the general operations of the MCHCP. This employee exercises a high level of professional judgment and discretion over legal matters, contractual issues, or in advising the Executive Director, Board of Trustees, and management regarding a wide variety of legal questions. The employee is responsible for coordinating the work of outside legal counsel retained by MCHCP. The employee has broad responsibility for the maintenance of professional and technical legal standards.

Salary Range:

$140,000-$160,000

Responsibilities - What you’ll do Provides legal advice and assistance to the Board of Trustees and Executive Director and other MCHCP personnel relative to the administration of state and federal laws governing the MCHCP.

Reviews all contracts entered by MCHCP and assists in preparation and interpretation of all associated legal documents (RFPs, contract amendments, etc.)

Reviews communication material prepared for distribution to the membership, governmental entities, vendors, and other stakeholders, as requested.

Serves as liaison between MCHCP and outside legal counsel retained by the Executive Director or Board of Trustees.

Reviews and analyzes current and pending federal and state legislation and assists in drafting proposed legislation and regulations or implementing new laws concerning MCHCP.

Conducts legal research on individual case questions concerning such items as eligibility, benefits, contracts, member-initiated appeals, and employment issues.

Reviews and aids and advice on the legality and propriety of the policies and administrative rules of MCHCP.

Responsible for executive management of assigned contracts.

Functions as HIPAA Privacy Officer and provides direction in the areas of HIPAA policies and procedures, training, and compliance.

Qualifications - All you need for success Minimum Qualifications: Requires a licensed attorney in good standing and admitted to practice before all state and federal courts in Missouri

Requires graduation from an accredited school of law and a minimum of five years of professional experience in the general practice of law or equivalent legal or quasi-judicial work in a governmental agency or with an employer-sponsored benefit plan.

Missouri state government work experience is preferred but not required

**Preferred Qualifications:**Extensive knowledge of the provisions of state and federal laws pertaining to MCHCP preferred.

Knowledge of pertinent court decisions relating to the functions of and benefits administered by MCHCP preferred.

Knowledge of administrative law, including procedures and requirements relating to fair and equitable adjudication of member claims and appeals.

Ability to coordinate legal activities of MCHCP with outside legal counsel retained by the Board of Trustees.

Ability to make independent decisions in accordance with established policies and procedures; and ability to prioritize, organize and perform work independently, using professional judgement, under the high-pressure demands of the position.

Ability to maintain confidentiality of all MCHCP information and records in accordance with Health Insurance Portability and Accountability Act (HIPAA) and other applicable laws and regulations.

Ability to review, analyze, and explain complex sections of law applicable to various issues, including preparation and presentation of written and oral legal opinions for the Board of Trustees and Executive Director as needed.

Ability to serve as a productive team member and the ability to demonstrate a professional and positive attitude while establishing and maintaining excellent working relationships with all levels of government; MCHCP Board of Trustees; MCHCP management and staff; plan members; vendors and the public.
